DIVISION AI INSTRUCTIONS REGARDING Orders Implementing Differentiated Case Management Plan, Designating Case to a Track, Order Setting Calendar Call and Case Management Conference and Directing Further Procedures

  1. Orders Implementing Differentiated Case Management Plan, Designating Case to a Track, Order Setting Calendar Call and Case Management Conference and Directing Pretrial and Mediation Procedures

    Pursuant to the 15th Judicial Circuit's Administrative Order 3.110 cases filed after September 1, 2023 will receive one of the three Orders below:

    1. Order Implementing Differentiated Case Management Plan, Designating Case to the General Track, Order Setting Calendar Call and Case Management Conference and Directing Pretrial and Mediation Procedures (DCMGJT). This track is for JURY TRIALS, and time to disposition is 18 months.
    2. Order Implementing Differentiated Case Management Plan, Designating Case to the Streamlined Track, Order Setting Calendar Call and Case Management Conference and Directing Pretrial and Mediation Procedures (DCMSNT). This track is for NON-JURY TRIALS, and time to disposition is 12 months.
    3. Order Implementing Differentiated Case Management Plan Designating Case to the Expedited Track, Order Setting Calendar Call and Case Management Conference and Directing Pretrial Procedures (DCMENT). This track is for FORECLOSURE TRIALS, and time to disposition is 8 months.

      Each of the above Orders contains a schedule with pretrial deadlines. Cases must be ready for trial by the date of Calendar Call/Case Management Conference, which is found in the first paragraph of section II: Scheduling, Continuances and Pre-Trial Deadlines of the Order Implementing Differentiated Case Management Plan.

      IMPORTANT NOTE: Cases will be reassigned tracks under limited circumstances. Re-designation is not for merely modifying deadlines or obtaining continuances. See Part 4(b) of Administrative Order 3.110.

  2. Calendar Call/Case Management Conference (CMC)

    In Division AI, Calendar Call/CMC is held in person in Courtroom 11C at 9:00 A.M. on the dates provided in the table below. The table also lists the corresponding trial docket for each calendar call. The first day of the trial docket is 10 days after calendar call.

    In person appearance at calendar call is strongly preferred. If a party wishes to appear via Zoom because of extenuating circumstances, a motion and order is required. Submit the proposed order on the Online Scheduling System and provide the motion as an attachment. If the motion is granted, the order approving the Zoom appearance will include procedures for calendar call and the Zoom information.

  3. Scheduling of DCM Case Management Conferences

    DCM Case Management Conferences are scheduled through the Circuit's Online Scheduling System under DCM--Case Management Conference Scheduling. Division AI DCM Case Management Conferences will be held on certain Mondays at 4:00 p.m. via Zoom. The available DCM Conference timeslots are posted on the Online Scheduling System.

    IMPORTANT NOTE: THESE DCM CONFERENCE TIMESLOTS ARE FOR SCHEDULING DCM CASE MANAGEMENT CONFERENCES ONLY. ALL OTHER MOTIONS THAT ARE APPROPRIATE FOR UMC (i.e., non-evidentiary motions that can be handled in 10 minutes or less) MUST BE SET ON UNIFORM MOTION CALENDAR FOR HEARING.

  4. Procedures for DCM Conferences

    No less than ten (10) days in advance of the DCM Conference the parties must file with the Clerk a Joint Status Report that:

    1. Concisely updates the court on the status of the case;
    2. Identifies pending motions and other matters the court needs to address; and
    3. If applicable, provides a proposed revised pretrial schedule.

    A sample Joint Status Report is attached as Exhibit "A" to the 15th Circuit's Administrative Order 3.110. The parties must upload the Joint Status report at least 7 days in advance of a DCM Conference through the e-courtesy feature of the Circuit's Online Scheduling System. The parties are to be prepared at the DCM Conference to address the topics listed in Rule 1.200(a) and for the court, at its discretion, to hear or set for hearing any pending motions.

  5. DCM Case Management Conferences Are Required for Trial Continuances

    If a case cannot be ready for trial by the date set for calendar call despite all good faith efforts, a motion to continue trial must be set for a Differentiated Case Management (DCM) Conference as described in the 15th Circuit's Administrative Order 3.110 (as amended). Any motion to continue the trial must comply with Fla. R. Civ. P. Rule 1.460, including verifications signed by the client(s). The Motion must be filed and the DCM Case Management Conference set no more than 30 DAYS from the last Defendant being served or as soon as circumstances giving rise to the need for a continuance becomes known and only for good cause. Every motion for a continuance must include a proposed amended Differentiated Case Management Order (DCMO) resetting each pretrial deadline that remains applicable and indicating the date set for calendar call when the case can be ready for trial.     If parties agree to change the deadlines in the DCMO, and the case remains ready for trial on the assigned calendar call date, they may do so by submitting an agreed order on the Online Scheduling System. A DCM Case Management Conference is not necessary. See Civil Differentiated Forms and Orders

Updated Information Regarding Appearance by Zoom

UMC hearings are being conducted remotely using the Zoom platform. When scheduling a UMC hearing on the Online Scheduling System, the hearing confirmation will include a Zoom link. As with special sets, each party has the option to appear via Zoom or in the courtroom if they wish.

For special set hearings of 15 and 30 minutes, lengthy evidentiary hearings, and non-jury trials, each party has the option to appear in person in the courtroom or remotely via Zoom. Please note: hearings that are scheduled to start at 3:30 p.m. or later will now be held via Zoom only. The order specially setting the hearing will reflect this.

Jury trials are conducted in person; however, witnesses may appear remotely via Zoom.

Important Notice Regarding UMC Hearings in Division AI

Please send all materials in hard copy for Judge Curley's review at least three (3) days in advance of the UMC hearing. When sending the paperwork for a hearing on a Motion to Dismiss, please provide the Judge with a copy of the OPERATIVE PLEADINGS. On a motion to compel discovery, please provide the operative discovery.

Important Notice Regarding Special Set Hearings in Division AI

Special Set Hearing slots of 15 or 30 minutes are obtained from the Online Scheduling System. FOR SPECIAL SET HEARINGS, PARTIES ARE GIVEN THE OPTION OF APPEARING IN PERSON IN THE COURTROOM OR VIA ZOOM; however, hearings that are scheduled to start at 3:30 p.m. or later will now be held via Zoom only. The order specially setting the hearing will reflect this. Once the hearing slot has been selected from the system, an order setting the hearing will be generated, which will contain the Court's Zoom information if one or both parties wish to appear via Zoom. The order is then submitted for signature and e-served through the Online Scheduling System. Please note that special set hearings are set by court order, not by notice of hearing.

In accord with the Order Setting Special Set Hearing, send all materials (notebooks, binders, etc.) in hard copy five (5) days in advance of the hearing for Judge Curley's review. If submitting a volume of materials (e.g., a binder) please ensure that the materials are bookmarked to allow the Court to transition through the materials efficiently. As noted above, when sending the paperwork for a hearing on a Motion to Dismiss, please provide the Judge with a copy of the OPERATIVE PLEADINGS. On a motion to compel discovery, please provide the operative discovery.

For lengthy hearings (i.e., more than 30 minutes) email a letter to CAD-DivisionAI@pbcgov.org specifying the amount of time requested and include a courtesy copy of the motion(s). Available dates/times will be provided. The party requesting the hearing will be responsible for conferring with the opposing parties and informing the court via email at CAD-DivisionAI@pbcgov.org of the agreed-upon date and time. An order specially setting the hearing will then be generated.

An Evidentiary Hearing requiring more than two (2) hours will receive an order placing it on a non-jury trial docket with a calendar call date.
