§ 44.1011(2) Fla. Stat. defines mediation as “a process whereby a neutral third person called a mediator, acts to encourage and facilitate the resolution of a dispute between two or more parties. It is an informal and non-adversarial process with the objective of helping the disputing parties reach a mutually acceptable and voluntary agreement. In mediation, decision-making authority rests with the parties. The role of the mediator includes, but is not limited to, assisting the Parties in identifying issues, fostering joint problem solving, and exploring settlement alternatives.
In Family cases (DR cases), mediation may be conducted by Staff Mediators for the Fifteenth Judicial Circuit. The cost is $60 per person, per mediation session, when the parties have a combined income of less than $50,000 annually; $120 per person, per mediation session, when parties have a combined income of more than $50,000 but less than $100,000 annually; and, if the combined income of the parties exceeds $100,000 annually, the parties will be required to obtain mediation services from an independent/private mediator. If a party is determined to be indigent, that party shall bring a copy of the Application for Determination of Civil Indigent Status (link) or appropriate court order to the ADR Office, in which case the fee will be waived for that party.
